My 2000 FLT manual say's 32 oz. and the oil level does come up to the spring plate when the bike is level. You should not only check the chain tension but adjust the clutch every 5k also. 99.9% sure to be your shifter shaft seal leaking. Get down & look up from the bottom at the side of your tranny. You'll probably see drip marks on it. When the seal goes oil will leak down the side of you tranny, blow onto your inner primary, accumulate near your primary drain plug & both drip & blow back onto you rear pulley.I am comparing the 2008 vs 2009 models (xbones) and can find only one difference that I think is significant. On all 2008 models except the Rockers, the oil capacity listed on HD's website is 3.0. For the 2009 models it is listed at 3.5.
